Bekirova E. Legal regulation of licensing of the certain kinds of commercial activities

The object of research: the public relations, which connected with licensing of the certain kinds of economic activity. The purpose of research is the elaboration of scientific recommendations concerning legal regulation of licensing of the certain kinds of economic activity and preparation of the offers on perfection of the legislation of Ukraine in sphere of licensing. Methods of research: dialectic, system analysis of legal definitions and categories, comparative-legal, formal-legal, historical. Theoretical meaning: the level of theoretical elaboration in a science of the economic law of a problem concerning perfection of legal regulation of licensing of the certain kinds of economic activity is raised. Practical meaning: the results of research can be used at perfection of normative base of regulation of the relations concerning licensing the certain kinds of economic activity. The separate recommendations are used in practical activity of research-and-production association "Medbiointeh", enterprise "Arttur", and also at teaching educational rates "the Economic law" and "Civil law". Scientific novelty: dissertation is complex research of legal regulation of licensing of the certain kinds of economic activity, in which the new scientific recommendations are elaborated. Licensing of the certain kinds of economic activity as multiaspect concept is submitted. The legal essence of procedure of licensing of the certain kinds of economic activity is revealed. The concepts of licensing and license legal relations , also control in sphere of licensing are determined. The criteria of reference of the certain kinds of economic activity to requiring reception of the license by the subject of managing are determined. The stages of procedure of licensing are revealed. The analysis of supervision and control in sphere of licensing, and also legal responsibility for infringements of the legislation about licensing is carried out; the offers to the legislation are formulated. Sphere of use are the subjects of the legislative initiative; the subjects of managing, the subjects to licensing; economic courts; higher educational institutions.
