Shchokina O. The Legal International Trade Usage as a Source of Private International Law

The dissertation is devoted to a complex research of legal international trade usage. The history of emergence and the process of formation of interna-tional trade usages are explored. The author finds that international trade usages regulate not only contractual, but also non-contractual commercial relations with a foreign element. The author defines the legal nature of international trade usage and meaning of governmental sanctioning for the formation of legal international trade usage. The author’s view onto correlation of the notions «legal international trade usage» and «international trade usance» is presented. International trade usages are complexly classified and their functions are ascertained. On the basis of research the recommendations for realizing legal policy in the field of sanctioning international trade usages are formulated.
