Kvasnickaj O. Legal regulation of the state registration of business activity's subjects

Object of research: the public relations, which arise in connection with state registration of the subjects of enterprise activity. The purpose of research is the development of theoretical and practical questions of legal regulation of state registration of the subjects of enterprise activity and preparation of the offers on perfection of the legislation of Ukraine. Methods of research: dialectic, system analysis, legal, formal-legal, historical. Theoretical and practical importance: the received results have increased a level of theoretical development in a science of the economic law of a problem of perfection of legal regulation of state registration of the subjects of enterprise activity. The results of research are used in practical activity of a department of the State registrars of the executive committee of the Odessa urban council, in activity of the legal company "Lawyer", and also at teaching disciplines "the Economic law" and "the Enterprise law". Scientific novelty: is complex research, on the basis of which a number of new conceptual both in theoretical, and in practical importance of rules is developed, is proved directed on perfection of legal regulation of registration procedures is formulated. The necessity of fastening at a legislative level of principles of state registration of the subjects of enterprise activity, branch belonging of institute of state registration of the subjects of enterprise activity to the economic law, with specification of a subject its legal regulation is revealed. The expediency of definition in the legislation of concept of the applicant and circle of persons who can be the applicants, and fastening of the legal responsibility for infringement of the legislation in sphere of state registration of the subjects of enterprise activity both applicants, and state registrars is proved. The additions and changes in the Law of Ukraine "About state registration of the legal persons and physical persons-businessmen" are offered. Sphere of use are the subjects of the legislative initiative; the subjects of business; economic courts at disposal of legal proceeding connected to application of the legislation on state registration in sphere of business; higher educational institutions.
