This thesis deals is containing the analysis of theoretical and practical questions related with the state regulation of the special authorized state government body -state service on right protection for plant varieties. The control -observant of state inspection on right protection for plant varieties activity which is submitted to state service on right protection for plant varieties according to the subjects of economy in the seed sphere. The analysis of acting legislation and the practice of state service on right protection for plant variety activity regulation. it jurisdictional authorities in the present field of activity. On the basis of legislational analysis and practice of work in the state system on right protection for plant varieties are indicated the main regulational tendency of legal relationship, which arise during the state regestration of applicant rights, authors rights for varieties guaranteeing, patent holder and other subjects in the present field. The scientific-practicalrecommendations concerning the legal regulation improvement in the intellectual property on plant varieties were made by creating the new and making changes in the present laws and normative juridical acts of the Ukrainian Cabinet of Ministers, the Ministry of agrarian policy, State service on right protection for plant varieties the institute of administrative - juridical responsibility concerning infringement in the intellectual property on plant varieties were analyses.
