Bontlab V. Civil regulation of domain names

The thesis is devoted to the research of civil regulation of the domain name as the means of individualization of participants of the civil turnover, of goods and services in the Internet. The main stages of formation of the domain names in the context of development of the network Internet have been considered, the analysis of peculiarities of the legal regulation of domain names, as well as of correlation of the domain names with trade marks, commercial names, geographic indications of origin of goods, with the international unlicensed names of medications and names of individuals has been performed, the necessity of cancellation of the priority of trade marks over the domain names has been grounded. It has been mentioned, that the right for the domain name shall arise after its registration by the non-governmental organizations and shall end from the moment of its exclusion from the relevant register. The arguments have been stated concerned with the reference of agreement on the registration of domain names to the agreement on rendering of services. The main methods of protection of legal rights and interests of conscientious possessors of the domain names have been revealed.
