Essay

The thesis presents complex analysis of legal regulation of employment probation period according to the Law of Ukraine. The place of probation period in the system of administration and staff management is determined. Interrelations and mutual influence of such categories as personnel administration, staff management and probation period are examined. By analyzing the subject, methods, principles and functions of staff management its influence on the institution of probation is shown. The author's view of both probation as the institution containing the whole complex of norms of Labor law and the result of its realization are substantiated. Legal nature of probation, its subject, result and legal effects are studied. The necessity of establishing different terms of probation period for different employees is proved. Factors influencing the efficiency of the institution of probation as well as guarantees and means of protection and restoration of individual's rights are determined.
