Mytsa Y. The legal nature of derivative securities.

This work is dedicated to the research of theoretical problems of the legal nature of derivative securities as civil rights objects. The investigation was provided on the basis of historical data, analysis of Ukrainian and foreing legislation, civil law science doctrine. Subjects investigated are the following: basic signs of derivative securities, correlation of derivative securities with the construction of civil law contract, classification of derivative securities, struture of legal relations, connected with the rights on derivative securities, civil law aspects of the issue of derivative securities, legal forms of derivative secirities circulation. The construction adequate to modern relations, connected with derivative securities, is proposed: to define derivative securities as law of estate object according to the legal open list; other derivatives should be defined as civil law contracts or their combinations.
