Andrianov M. Means and legal regime of securitization of credit obligations

The thesis is dedicated to the research of theoretical and practical problems connected with legal relationships of pledge of securities. In this thesis based upon the analysis of the regulations of Ukraine's legislation and legislations of a number of foreign states the following problems are under research: the issues of definition of the security and means of security, basic elements of a security right, obligations to be secured, assets to be encumbered, security agreement, formalities, transfer of possession, control, notification, publicity, purpose of conflict-of-laws rules, scope of conflict-of-laws rules, conflict-of-laws rules for creation, publicity and priority, conflict-of-laws rules for enforcement issues. A number of theoretical provisions as well as proposals aimed at improving of the Ukraine's legislation in force for the purpose of providing of the adequate legal regulation of secured financing are grounded in this Ph.D thesis.
