Pushay V. Cession and delegation in civil law (upon court practice materials).

The thesis is devoted to the problems of the cession and delegation in civil law, the scientific research is based upon court practice materials. Main historical stages and prerequisites of developing of this institutions in Roman private law and according to national legislation of different periods are analyzed in the work. Main elements of passing the chose in action such as conception, subject, grounds and consequences are researched in the work. Requirements are formulated which chose in action must meet to be a subject of concession. Conception and the main kinds of restrictions of chose in action concession are described in the work. Problems of some of them are analyzed. Besides impossibility of passing the prior rights is substantiated. The attention in the thesis is paid to a mechanism of delegation. Besides grounds, conditions, consequences, limits and restrictions of delegation are studied.
