Kafars'kyj V. Investment contracts in Ukraine: concept, types, content, legal regulation

In the thesis on the basis of the analysis of scientific literature, national legislation of Ukraine and of other countries the main problems of legal regulation of investment contracts in Ukraine are investigated, and a new definition of the investment contract concept is given, the legal status of the contractors of the investment contract is defined, the procedure of its conclusion is analyzed, and the analysis of essential, typical and occasional conditions of the contract is carried out. The legal nature of the investment contract is specified, the criteria and types of the investment contract are developed. The peculiarities of the legal regulation of such types of investment contracts as investment contract in housing, treaties on production distribution, concession contract, financial leasing contract are analyzed in detail. A number of suggestions concerning alteration and additions to the legislation that regulates contractual relationship in the sphere of investment activity are substantiated.
