Yesipova L. The guarantee in civil law.

Dissertation is devoted to analyze of guarantee conception as the way of securing the obligations. The questions of law nature, main features of guarantee, definition of its place in system of means securing obligations are being researched. The process of formation of guarantee idea is being considered beginning from Roman private law until today. The modern conception of guarantee is also analyzed. The bases of arise and cessation of guarantee law-relations, specific features of law totality, which involves arise of these relations are being characterized. The specifications of different forms of guarantee, their correlation with adjacent civil law institutes are being considered. Theoretical conclusions on base of researched questions and practical proposals, which are directed on improvement of regulation of guarantee institute in civil law system of Ukraine, are being formed."
