The dissertation is devoted to complex economic - law research of the legal rate of communal property, to working out of theoretical fundamentals of this law institute and basing of propositions concerning an improvement of norms of an appropriate legislative institute. The category "legal rate of property", elements of the legal rate of property are researched. Signs of the communal property law as an independent form of a property and a kind of a public property are determined; a system of normative acts determining a legal rate of the communal property is outlined. A legislative list of communal objects is analyzed, perspectives of its improvement are determined. Foundations of origin and discontinuance of the communal property law are researched. Possible ways of an improvement of legislative norms determining a mechanism of forming, administration of communal property and joint property of territorial communities are offered. The legal rate of estate of all kinds of economic subjects of communaleconomic sector are analyzed.
