Krylova O. Civil Regulation of Relations Based on Rendering Medical Aid.

In the dissertation the legal nature of relations on rendering medical aid is analyzed, the concept of medical aid and the essence of the right to such help is investigated. The legal analysis of the grounds for the appearance of legal relationships of granting medical aid among which the most widespread is the contract about rendering medical aid. Such contract is considered as a civil transaction with specificity of its conclusion, its contents and the termination. The rights of the patient, adjacent with the right to medical aid, such as: the right to medical secret, to the medical information, etc. are investigated The peculiarities of legal regulation of some kinds of medical aid (psychiatric, palliative) are singled out. Consequences of infringement of treaty provisions are looked into. On the basis of the legal analysis of the domestic and foreign legislation in force, the legal and medical literature, scientific conclusions are drawn, suggestions concerning improvement of the Civil code of Ukraine, the Law of Ukraine «The Bases of the Legislation on Public Health Services», and of expediency of introduction of the separate law on the rights of the patient of medical institution are made.
