Koryakin R. Restitution in contemporary criminal procceding of Ukraine

Об'єкт дослідження - criminal procedure regulation of legal relations arising owing to injury to the physical and legal persons as a result of committing a crime and its compensation with the help of the restitution. Мета дисертації - engineering of the theoretical provisions concerning restitution as the forms of compensation of the material loss, caused by a crime, definition of a place and role of the given legal institution in system of guarantees of the rights injured from a crime, finding of possible variants of improvement of the legislation regulatory questions of the legal restitution. Методи дослідження - dialectic, formal-logic, comparative jurisprudences, historical, system analysis, sociological, statistical. Наукова новизна - for the first time the questions connected to definition of legal nature of the restitution are construed; the order of conducting of the legal restitution in a stage of pre-trial investigation and trials is offered; the definition of the contents of tasks and functions of the criminal procedure is perfected. Практичне значення - provisions of the dissertation can be used in legislative practice, research job, educational process, practical activity of the judges, inspectors, procurators. Предмет і ступінь впровадження - conclusions of the dissertation are useful at a spelling of the manuals at the rate "the criminal Procedure of Ukraine ", by preparation and recital of lectures on subjects "the civil Action in the criminal trial", "the Evidences and proving", "Investigatory actions".
