Essay

The dissertation is devoted to the research and foundation of theoretical and practical problems of the juridical category of principle of justice. The dissertation is pointed at the complex analyses of how the principle of justice emerged and was realized in Roman Private Law. The role of this principle and it's realization and in modern liability Law of Ukraine is also in the focus of attention. The phenomenon of juridical category of principle of justice is defined on the basis of analyses of doctrinal research, the legislation of Ukraine and these of other states, of private international law. The main task of the given theoretical research is the scientific comprehension of principle of justice. Norms and ideas of the Roman law were analyzed. Prospects of how and which extent similar ideas and norms are applied in the Civil Codex of Ukraine are outlined. Which led to the conclusion that principle of justice is a system-forming general theoretic principle of Civil Law$ this principle determines thescopes of how legal subject actually exercise their rights. The results obtained as well as the conclusions made may be applied in the modern civil legislation of Ukraine for the purpose of providing and providing the guarantees that the principle of justice be followed."
