Essay

The thesis deals with the theoretical and practical analysis of the application of private legal mechanism of marine environment protection from pollution by ships, defining the conception, legal nature, and peculiarities of civil liability for the damage caused by pollution by ships in international private maritime law. Special attention is paid to the legal mechanism of marine environment protection from pollution by ships, its main categories; the system of international legal regulation of marine environment protection from pollution by ships and its main subsystems. The thesis also investigates the interaction of public and civil regulations in the international mechanism of marine environment protection from pollution by ships, peculiarities of the conventional regulation of civil liability for the marine damage in the international private law and the peculiarities of unification of standards in the international private maritime law. The peculiarities of international legal regulation of the ship arrest, under the requirements on marine environment pollution by ships, and international standards of marine environment pollution insurance are thoroughly analyzed. On the grounds of legislation, juridical practice and corresponding international conventions the thesis presents recommendations on the improvement of private mechanism of the Ukrainian marine environment protection, the order of implementation of the norms of international conventions, on civil liability for the damage caused by pollution by ships, into the legislation of Ukraine and the appropriateness of its participation in these conventions."
