In dissertation, research and development is explored criminal - executive law in Ukraine from the end of XVIII - to beginning of ХХ century, problems of activity of penitensiary institutions in a noted period of time. That time the Russian government begins to use widely imprisonment, gradually refusing from the previous forms to fight criminality. On the basis of analysis of literature, legislative acts and archived materials forming of penitentsiarnogo legislation is explored, modernization of the prison system, activity of places of imprisonment in the Ukrainian provinces of Russіа. It is shown in dissertation, that research problems touch the fundamental bases of reformation of modern criminally - executive legislation and functioning of penitentsiarnih establishments. Results got in the process of research can be objectively instrumental in more clear determination of teoretico - conceptual bases of perfections criminally - run-time system.
