Essay

The thesis deals with the theoretical analysis of legal heritage of I. Petrunkevich. His views upon state and low are set systematically for the first time. The main stages of his social and political activity are proposed. I. Petrunkevich emphasized the methodological approaches to the problems of state and law, which are based on the natural legal theory in its renovated variant at the beginning of the 20th century. On accordance which this approach the rights of the people are not unchanging, but develop together with the development of the society. According to his conception of the constitutional state, I. Petrunkevich considers the state as legal one, that is in the process of refinement. The form of the state, relationship between state and law, state and personal rights and freedoms, views upon organization of Constitutional jurisdiction are marked by I. Petrunkevich too. The model of local self-government organization which was proposed by I. Petrunkevich and the ways of lawful settlement of the national question are examined. The state-legal views of I. Petrunkevich are considered in correlation with the views of his contemporaries are considered. The level of the conformity of his ideas to our time is determined.
