Drishlyuk V. Public agreement: civil law aspect

Dissertation for a candidate Degree in Law in speciality 12.00.03 - Civil Law and Civil Process; Family Law; Private International Law. - Science Research Institute of Private Law and enterprise of Academy of Law Sciences of Ukraine, Kiev, 2007. Dissertation is devoted to the research of law nature, signs and regime of law regulation of public agreement. This caused by the necessity of elaboration the theoretical models of mentioned law phenomenon, improvement of acting legislation and mechanisms of law regulation agreements, where the economical inequality of their individuals is observed. At first on science is being done the research of juridical nature of public agreement by the legislation of Ukraine. The basic goal of the dissertation's research is the reveal of the maintenance of public agreement with the help of system analysis of it's law base, and it's law application, the reveal of blanks and contradictions in legislation in this sphere, forming of recommendations, ground of totality proposals about improvement of practice of it's application. In dissertation is consistently researched the juridical nature of public agreement, it's civil-law characteristics, it's correlation with join agreement. The specific features of it's subject, law legislation on the stage of conclusion and fulfillment are being researched. Its specific features and conditions are being revealed. This caused to distinguish this agreement as separate institute of Ukrainian civil law. The proposals of improvement of Ukrainian civil law are formed.
