Essay

The dissertation is dedicated to research and substantiation of the proprietary interest theory as well as to generalization of the historic experience and the experience of foreign countries. It generalizes the problems of consideration of such cases by courts of Ukraine and advances the proposals aimed at improvement of the legislative rules, notarial and judiciary law. In particular, the dissertation gives an analysis of the recent tendencies in civil law and defines the possibility of identification of a proprietary interest both on the grounds of a contract and based on a court decision.
