Lyovkin V. The affidavit of the accused person in the criminal process of Ukraine.

The essential, the signs and the legal status of the accused person were investigated. The concept "the affidavit of the accused person" is given. The affidavit of the accused person is the source of proofs, which are reported by the accused person during the interrogation or confrontation in time of preliminary investigation or legal procedure in a court of first appearance or appeals court in accordance with the demands of the law. The author proves that the affidavit of the accused person has double procedural nature - it is a source of proofs and the way of defence against accusation. Stated that the simplified procedure of the legal procedure set in the articles 299 & 301-1 of the Code of Criminal procedure is imperfect. The proposals as to its improvement are formulated The peculiarities of the affidavit of the accused person in the appeal court, in cases of under age crimes, cases of the private accusation and during solving the question of the arrest of the accused person are investigated.
