Sajiv S. Legal Regulation of Migration and Registration of Individuals in Ukraine (Administrative-Legal Perspective)

The dissertation is an integrated study on problems concerning administrative-legal regulations of migration and registration of individuals on current stage of development of Ukrainian society. In this paper a different world view ideas, point of views and scientific approaches toward migration and registration of individuals is examined and analyzed, historic-legal conditions of emergence and development of migrational and registration procedure are differentiated, a parallel is drawn between the residential permit and registration of individuals. A system of assets, which are basics for regulation of migration procedure and registration of individuals, is examined. Analyses were made of registration procedure of individuals by their addresses and staying addresses, problems of such procedure were defined and ways of resolution were proposed. Problems concerning government body action, under jurisdiction of which lies control of migration and registration procedures are examined, so a group of individuals with legal relationship with migration was defined, as well as registration of individuals. Methods of administrative compulsion are presented and analyzed, which were used against counteraction of violation of migration and registration rules, according to triple destination: administrative-preventing measures, administrative-termination measures and administrative penalty. Number of general conclusions is presented, scientific-practical proposals are substantiated concerning effective procedure of registration.
