Didkovska I. Ombudsman in the system of institutes legal state: Rather end Political Analysis

Direction of dissertational research is definition of the status Ombudsman as element of political system of Ukraine and countries of the European Union. For the first time the problem of definition of a role of the given institute in political system, taken out and it is offered to determine the status of ombudsman as peripheral element of political system. It is analyses object of ombudsman activity, that means protection of the rights and fundamental freedoms of citizens; is carried out researches of genesis of the right of human rights, being based on perception of the person as full subject of the international relations. It is investigated a theoretical basis of functioning of the legal and social state and it is ascertained the fact of absence of the uniform, precisely determine definition of a lawful state. It is carried out the analysis of offers concerning improvement of the status of Ukrainian ombudsman and it is offered a projects of changes in the Law of Ukraine "About the Representative of the Supreme Rada of Ukraine under human rights". It is argued necessity of expansion of powers ombudsman by reception of the power to initiate legislation, the argument concerning introduction in Ukraine of posts specialized of ombudsmans. It is investigated models of ombudsman institute, existing in many European countries that has enabled to receive a conclusion that, in independence of features of purpose and a circle of duties and the powers, the given element protections of human rights services remains the influential tool as protections of human rights, and preventions of infringements in this branch at the state level.
