Butyrskiy А. Legal Regulation of Measures on Restoration Payment of the Debtor

The dissertation is devoted to research of legal regulation of measures on restoration payment of the debtor in procedure of bankruptcy. The historical preconditions establishment of institute of measures concerning restoration payment of the debtor is investigated and the foreign experience of legal regulation is analyzed. Are certain and the measures on restoration payment of the debtor are systematized. The institutes of the moratorium on satisfaction of the requirements of the creditors, stopped term, recognition of the agreements void and failure of performance of the contracts of the debtor are analyzed. The conditions of application of offset of the counter homogeneous requirements in procedure of bankruptcy are certain. The contents of measures sanation is opened and their classification is advanced. In work by the author the stated theoretical conclusions and practical recommendations for improvement of the Law of Ukraine "About restoration payment of the debtor or recognition by his bankrupt".
