The dissertation is devoted to the complex research of application problems of administrative inspection and search by militia organs in the context of keeping rights of a person and a citizen subjected to the administrative enforcement measures. The necessity to implement a new term „administrative search” in legal usage has been substantiated in the research; the definitions „administrative inspection” and „administrative search” have been formulated; a range of authorities of militia organs who are authorized to carry out administrative inspection and search have been defined as a system and their competence has been revealed; the mechanism of administrative-legal regulation of administrative inspection and search has been analyzed at a new conceptual level, its elements have been characterized as a complex; the grounds and theoretical-legal provisions of procedural form of administrative inspection and search have been revealed and specified in detail; the legal guarantees of rights of citizenswho are subjected to administrative search have been identified. A number of propositions to improve the current administrative and administrative-procedural legislation in the regulation acts of administrative inspection and search have been first formulated at the conceptual level in the work.
