Bignyak A. Business as a subject of legal regulation in Ukraine

Object of research: the public relations, which arise in connection with organization and realization of enterprise activity. The purpose of research: a substantiation of new scientific rules concerning business as a subject of legal regulation and preparation of the offers on perfection of the legislation of Ukraine in sphere of business. Methods of research: dialectic, system analysis, rather-legal, formal-legal, historical. The theoretical and practical meaning of the received results consists in increase of a level of theoretical development of questions of legal regulation of business in a science of the economic right. The results of research can be used in the right creativity of activity with the purpose of development and perfection of legal regulation of enterprise activity in Ukraine; Were used in practical activity by development of changes in the charter of the enterprise, by development of the local-normative act - Code of professional behaviour; are used in educational process at teaching discipline „the Economic right". Scientific novelty: first the right to business activity is defined as a right to independent, initiate, innovation, professional, systematic activity for the first time is proved, with the purpose of achievement of economic and social results, and reception of the profit in conditions of existence of risk, with observance of the rights and lawful interests of other persons, and responsibility for results of such activity of its subjects. The concepts and kinds of business are determined. The attributes of business are revealed. The question of the subjects of the right on enterprise activity is modified. The meanings of the social responsibility and ethics in realization of the right on enterprise activity are revealed. The offers on perfection of legal regulation of business are proved. Sphere of use: the subjects of the legislative initiative, subjects of managing by development of the projects of the specifications-legal acts on regulation of enterprise activity; highereducational institutions.
