Dobrovolska V. Legal basics of the government regulation of business activity in Ukraine

Object of research: public relations which arise up in connection with government control of entrepreneurial activity. The purpose of research: development of new scientific positions of legal principles of government control of entrepreneurial activity in Ukraine and preparation of suggestions on the improvement of legislation of Ukraine in this sphere. Methods of research: dialectic, comparative-legal, formal-legal, historical, system-functional, method of abstracting. The theoretical meaning of the got results consists in the ground of directions of improvement of the legal adjusting of relations which arise up in connection with government control of entrepreneurial activity, for its more effective realization. Practical meaning: positions of dissertation can be used for creation of comments to the normatively-legal acts, in scientific practice activity; positions of dissertation were used in educational process at teaching economic disciplines and disciplines of right in the Odessa national legalacademy of Ukraine, separate positions were used in practical activity of enterprise of "Caesar" Ltd during development of the system of the legal providing of standardization and certification of enterprise, and also by enterprise „Metalloprom" at development of local normatively-legal act - it's Statute about organization of realization of licensing of economic activity. Scientific novelty: The legal ensuring of government regulation of business activity is given. The balance of government regulation and self-regulation in the sphere of business is revealed. The concept and kinds of means of government regulation of business activity are defined. The analysis of different means of government regulation of business, including government order, government task, licensing, patenting, quotation, standardization, certification and other means, as well as their legal ensuring are provided. The analysis of legal ensuring of government regulation of prices in the sphere of business carried out. Propositions on perfection of legal basics of the government regulation of business activity in Ukraine are proved. Sphere of use: the subjects of the legislative initiative, subjects of managing by development of the projects of the specifications-legal acts on regulation of enterprise activity; higher educational institutions.
