Sabodash R. Credit risk insurance: civil law aspects

The thesis represents an autonomous complete scientific work, the first comprehensive theoretical study of credit risk insurance in civil law in Ukraine. Based on the analysis of literary sources, regulations of effective civil legislation and the practice of its application, the thesis interprets the concepts and characteristic features of risk, credit risk, credit risk insurance, the debating issues concerning legal status of the insured party; it provides the analysis of the instructions contained in the EU Directives in the area of insurance and credit risk insurance, the foreign experience in some aspects of application of credit risk insurance in the banking area, the concept, signs and contents of credit risk insurance contracts. The study has culminated in formulation of a series of new scientific conclusions and proposals as for improvement of the existing civil legislation, in particular, concerning introduction of specific changes and/or amendments to the Law of Ukraine "On insurance". In addition, the author advises to work out Standard Credit Risk Insurance Regulations.
