Gabriadze M. Obligations, arising as the result of creation of threat to life, health, property of physical person or property of legal entity, in the civil law of Ukraine

The dissertation is devoted to research and to make a conclusion of theoretical bases of obligations, which rise up as a result of creation of threat to life, health, property of physical person or property of legal entity, in the civil legislation of Ukraine. Considerable attention is given to the analysis of ques-tions concerning the forming of categories of obligations, which rise up in connection with creation of threat by law to the rights and interests in the civil legislation. It follows a treatment of the concept of obligations, which arise in con-nection with creation of threat to life, health, property of physical person or property of legal entity, for CK of Ukraine of 2003. It is also paid attention to the consideration of legal nature of the compensation of harm, that arose as a result of no removal of the threat, created to life, health, property of physical person or property of legal entity. It is carried out a further analysis on features of compen-sation of harm, inflicted as a resultof no removal of the threat, created to life, health, property of physical person or property of legal entity, subject composition and mainte-nance of the explored obligations. In the dissertation suggestions for the improvement of norms of the current legislation are formulated. Keywords: obligation, compensation of harm, creation of threat, risk, legal responsibility.
