Grekov E. The copyright to products of architecture

The dissertation is devoted to the analysis of the theoretical-legal problems of a recognition, realization and protection of copyrights to products of architecture. In particular, in work preconditions of occurrence of the copyright to products of architecture as separate legal subinstitute are investigated, its concept is formulated, the legal characteristic of the basic attributes of product is given and their specificity according to an object of research on the basis of that definition of product of architecture as object of the copyright is offered is revealed. In the dissertation, the legal nature and the contents of the subjective copyright to products of architecture is opened, civil-law ways of its protection are analysed, the essence of legal institute of architectural supervision in construction as element of system of protection and protection of the rights of authors of products of architecture is determined. Specific proposals and recommendations on improvement of the legislation of Ukraine in sphere of protection of the rights of the intellectual property on products of architecture are developed.
