Kovalko N. Financial and Legal Regulation of Settlement Relations under Special Conditions (as exemplified by Ukrainian Fuel-and-Power Complex).

This dissertation research deals with the legal regulation of settlements relations under special conditions introduced within Ukrainian Fuel-and-Power Complex. The paper has discussed some concept and content issues for the legal regulation of settlement relations, their pattern and legal treatment as well as analyzed the questions of concept, essence and place of special conditions in the system of settlements, their features. The theoretical section considers settlements under special conditions as a part of the general system of settlement relations in Ukraine. In this context there are disclosed the concept and content of settlements and settlement relations, their principles and other elements, as well as analyzed some controversial opinions on several key matters of legal regulation thereof (e.g. on correlation of such concepts as "settlements" and "payments", bank functions in settlement relations, etc.). The main attention has been focused on such categories of settlements as a legal regime, principles, forms and other elements of settlement relations. There are differentiated civil and financial-and-legal aspects of settlement relations as well as shown some public aspects of settlements in diversity of fields thereof. Based on the discussed general theoretical provisions on settlements the author has formulated the concept of settlement relations under special conditions having been fully introduced both in the electric power industry and in other sectors of Ukrainian fuel-and-power complex.
