Levchuk L. Economic the responsibility of businessmen for infringements in the consumer market

Object of research: the public relations arising at realization by the businessmen of infringements in the consumer market and approach for such infringements of the economic and legal responsibility. The purpose of research is the development of theoretical and practical aspects of application of the economic and legal responsibility to the businessmen for infringement in the consumer market. Methods of research: historical-legal, rather-legal, system analysis, synthesis, deduction, induction, comparison both opposition. Theoretical and practical meaning: are profound and the theoretical development concerning the economic and legal responsibility of the businessmen for infringements in the consumer market are advanced in a science of the economic right. The offers on addition and modification in an item 23 of the Law of Ukraine "About protection of the rights of the consumers" are proved. The results of research are used by the Main Donetsk and Main Lugansk regional managements on protection of the rights of the consumers, State committee of Ukraine on technical regulation and consumer politics (State consumer standard of Ukraine), judges Avdeevka of urban court of Donetsk area at disposal of legal proceeding under the claims about protection of the rights of the consumers. Scientific novelty: is first in Ukraine by complex scientific research of the economic and legal responsibility of the businessmen for infringements in the consumer market. The contents of concepts "the consumer market" is determined, "consumer", "seller", "quality of production", "set of the goods", is opened the contents of concept of protection of the rights of the consumers. The bases and forms of the economic and legal responsibility for infringement in the consumer market are investigated, the offers on addition of the list of infringements in this sphere are made, for which there should come the economic and legal responsibility. Are formulated and are brought in a line of the offers on perfection of the current legislation ofUkraine with the purpose of increase of efficiency of the administrative penalties, restriction and termination of activity of the subject of economic activity, penal and operative-economic sanctions. Sphere of use are the subjects of the legislative initiative for perfection of the legislation regulating the consumer market; higher educational institutions.
