Ostrovska L. Derivative Action in International Experience and Ukrainian Law.

The thesis considers theoretical and practical legal aspects of derivative action in foreign and Ukrainian law Reviewing the law and practice of Great Britain, Israel, Germany, Russia, the United States and other countries the author analyzes the definition of derivative action, basic characteristics of derivative action, and its place in the general theory of civil actions. Ukrainian substantive and procedural law related to derivative actions and its application and interpretation in judicial practice are also considered. Amendments to the Ukrainian legislation are proposed to provide detailed regulation of substantive and procedural aspects of derivative actions of shareholders and creditors of legal entities in Ukraine."
