Androsov S. Providing of implementation of economic obligations arising up in the sphere of bank crediting

Object of research: a complex of the relations arising in sphere of bank crediting of the subjects of managing. The purpose of research is the development of scientific rules on increase of efficiency of functioning of the mechanism of legal maintenance of performance of the economic obligations in sphere of bank crediting and preparation of the offers on perfection of the credit-bank legislation of Ukraine. A method of research: dialectic, system, historical, rather-legal, formal-legal. Theoretical and practical meaning: are complex research of system of means of maintenance of appropriate performance of the economic obligations in sphere of bank crediting, the concrete offers on perfection of the national legislation are formulated, the offers on modification in the Economic code of Ukraine, Civil code of Ukraine, Law of Ukraine "About maintenance of the requirements of the creditors and registration of burdenings" are made. The results of research can be used during realization of financial monitoring of crediting of the subjects of managing, at organization and realization credit-monitoring of work; were used by Charitable fund of assistance to formation and improvement of professional skill in legal relations with credit-financial establishments, in educational process at teaching disciplines "the Financial right", "the Economic right", "the Bank right". Scientific novelty: use of the terms "economic legal relations in sphere of bank crediting", "an economic offence made in sphere of bank crediting" is proved the definitions of concepts "pledge" and "a state guarantee" are advanced. The ordering of kinds of maintenance of performance of the economic credit-bank obligations and offences in sphere of bank crediting, and also determinant of an economic credit-bank offence is carried out. The expediency of the further development of formation of the specification-legal base on regulation of a bureau of credit histories is proved. The order of application of a pledge and state guarantee is advanced. The offers on perfection of the current legislation of Ukraine are brought in. Sphere of use are the subjects of the legislative initiative, bodies of state management, judicial bodies, subjects of managing during crediting the subjects of managing; higher educational institutions.
