Tatsij L. Legal nature of advocacy in the system of protection of rights and liberties of person and citizen

Characteristics of advocacy's legal nature and legal regulation as an institution of guaranteeing of the right of defense from charge and granting with legal help are researched in the dissertation. On the grounds of conceptual arsenal of the theory of state and law specific features of community-self organizing (non-governmental) status of advocacy were defined. Functions of advocacy in tight interrelation with its general social purpose were specified. Peculiarities of legal status of advocate in its relation to legal status of citizen, considering features conditioned by advocacy activity, were examined. Principles of organization and functioning of advocacy in Ukraine in the context of international standards were analyzed. Legal forms of participation of an advocate in legal process were disclosed.
