Byegova T. The concept of "Know-how" and agreement of its assignation.

The dissertation contains a complex research of problems of development of mechanism of legal provision of "know-how" commodity turnover, and also of its assignation under conditions of codification of civil legislation of Ukraine. The author analyzes concept and features of "know-how", reveals concept of right on it and means of its protection, defines grounds for origin, changes and termination of "know-how" right, determines subjects of right on it. Main attention is paid to the problem of definition of "know-how" assignation agreement as an individual type of contract relations and separation it from other contract institutions, which look similar to this agreement, first of all, licensing agreements. The author analyzes making of "know-how" assignation agreement, its structure, essential conditions of this agreement, and also responsibilities of parties for its non-execution of improper execution. The suggestions concerning improvement of current legislation of Ukraine in the field of "know-how" legal regulation have been formed.
