Chevychalova Z. The Legal Nature of a Branch Establishment.

The manuscript is dedicated to the complex research of the legal regulation of relations that appear in the creation and functioning of branch establishments and their legal nature. Pre - conditions of the emergence and evolution of the development of a branch establishment as a self organizational legal form of management are analysed, their historical and economic reasons are exposed. The ways and conditions of establishing of the control - subordination between a controlling business and a branch establishment with the participation of a foreign element in particular and their legal consequences are analysed. The problems and prospects of the development of the legal regulation of relations that appear in using of such form of business as a branch establishment in Ukraine are defined. Proposals on the improvement of the current legislation in Ukraine on the questions of branch establishments with the participation of a foreign element are formulated.
