Essay

The thesis is devoted to the complex private research protection of rights in favour of trademark in international private law as well as possibilities and direction of implementation of leading experience of foreign states in Ukrainian legislation. First at scientific level there is confirmed that the subject of international private law coincides with the subject of civil law on the main basis and it serves universalization of legal settlement of these relations. Incorporeal right has been formed as all- sufficient one and as a part of international private law. There has been determined that the relations concerning the TM serve the business, realization of goods and services on the home and foreign markets, they are inalienable attribute of market economy. It advantages protection not only of producer's but customer's interests. Advisability of the term «trademark» for using in legislation has been grounded. There is stated that international legal settlement of rights in favour of TM is starting for unification of protection of rights in favour of TM all over the world. The right to defence is regarded as severalty - the carrier legal possibility of carrier the broken civil law of own actions or application with such protection to renew broken laws, to suspend infringement and compensation of caused harms by him. According to positive experience of work of foreign states' organs the propositions have been supported: for increasing the authority of Appeal Chamber of State Department of intellectual property; about creation of specialized patent court where all disputes in sphere of intellectual property are considered, the development and adoption of Patent Code of Practice."
