Bolokan I. The legal obligation and special means of protection of the ownership in the entrepreneurial activity

The thesis is devoted to the complex research of the obligation-legal and specific means of protection of the ownership and peculiarities of their application by such specific category of the subjects of civil law as entrepreneurs, to clear up the place and the role of the obligation-legal and specific means of protection in the system of the civil law means of protection of the ownership, to determine the flaws and shortcomings in the legal regulation of the questions mentioned. The most widespread contractual legal obligation means of protection (enforcement of the debtor to deliver in kind, cancellation of the contract, unilateral refusal of the contract, application of penalties etc) are analyzed in the thesis. Besides, the author also pays attention to non-contractual obligations stipulated in the Civil Code of Ukraine as well as to the means of their protection available for the parties.
