Serebryakova Y. Lease contract of state and municipal property

Object of research: public relations, which are forming in process of making, execution and dissolution of lease contract of state and public real estate. The purpose of research: development of new scientific positions and recommendation on improvement of contractual relations of lease state and public real estate on a base of the analysis and generalization of the legislative regulation of corresponding relations, results of theoretical research, domestic economy practice and foreign experience. Methods of research: dialectical, formally-logical, semantic, comparative-legal, method of the analysis and syntheses. Theoretical and practical meaning of the received results consists in study and improvement of the contractual relations of the lease state and public real estate purposely increasing efficiency of its use. The results of a study were used in the work of the committee of supreme Rady of the Ukraine on questions of legal policy with the improvement of the acting economic legislation, they found a practical use in the work of OOO "Donbass- office", during permitting accommodation with economic courts, preparing of the tutorial "The economic law" and methodical material to this course. Scientific novelty: the notion of the lease state and public real estate is elaborated, order of the development and approving of the Standard contracts of the lease state and public real estate is developed, the content and form of the lease contract is studied, and propositions of requirements improvement to them are worked out. It is motivated the improvement necessity of order improvement of realization of the lease object, the notions of the inseparable improvements are determined. The Certain particularities of order of making, execution and dissolution of the lease contract of state and public real estate are defined and the offer of its improvement is designed. The directions of the improvement of economic-legal responsibility for breaking the contractual relations in corresponding field are offered. Sphere of the use: subjects of legislative initiative, subjects of management and organs of state authorities and local self-government during making, execution and dissolution of the lease contract of state and public real estate; the high educational institutions.
