Nyzhnikova V. Administrative and procedural status of subjects in violation proceedings of castoms rules

The thesis is a scientific research in which an analysis of problem issues connected with determination of administrative and procedural status of subjects in violation proceedings of customs rules, is carried out. On the basis of all round analysis of norms of Ukrainian current legislation and generalization of practice of its realization the author has improved the concept " violation proceedings of customs rules" and worked out in detail its correlation with closely - related political and legal categories. In the given investigation specification of place and role of violation proceedings on customs rules in the structure of administrative process has been further developed with clue account of the latest scientific works. The existing views at the system of subjects in administrative law breaking proceedings have received further development in the dissertation. The system description of administrative and procedural status of all subjects in violation proceedings of customs rules has been accomplished for the first time. The author has proposed a classification of participants in the investigated administrative proceedings. The classification was given for several reasons and in some stages what gave an possibility to analyse more deeply their legal rights and duties.
