Boyarsky O. Compensation for a damage caused by decisions, acts and court's inaction.

The thesis is devoted to research and substantiation of theoretical obligation's grounds which appear as a result of caused damage by unlawful decisions, acts and court's inaction. Definition, typology and content of mentioned obligation have been analyzed. A great attention has been given to general characteristic of obligation which appears as the caused damage by unlawful decisions, acts and court's inaction, definition of their place in the system of obligations. The analysis of peculiarities of obligations' subjects which appear as a result of caused damage as well as specific of grounds (condition) of their appearance have been analyzed. Specifically, the categories of lawlessness of decisions, acts and court's inaction as the grounds of appearance of mentioned obligations, order and scope of compensation for the damage which has been caused by these subjects, have been analyzed in detail. The proposals concerning with improvement of valid legislative norms and coordination of provisions of CivilCode of Ukraine and civil procedural legislation of Ukraine."
