Essay

The dissertation is dedicated to research a judgment as fundamental institute of civil procedure. Judgment's analysis as a dynamic procedural phenomenon, which modifications is in correlation with the basis characteristics of justice, is the main scientific methodological result of this dissertation. Here judgment is researching as structural component of civil procedure and as part of legal order in the state simultaneously. Author proves that civil procedure has relatively steadfast structure, court proceedings is a main parts (components) of this structure, judgment is a structural component of an autonomous court proceeding, because the procedural legal result is fixing and afterwards existing only in judgment's form. Much attentions is devoted to the analysis of legal nature of different autonomous court proceedings of civil procedure in Ukraine and other countries, different types of judgment as a final court acts in this proceedings and juridical problems of legal protection of citizen's rightsand interests by means of simplify court proceedings (an order, correspondence and summary proceedings). In consequence the author makes suggestions concerning improvement of civil procedural legislation.
