Shadura D. The Civil Jurisdiction

The thesis is dedicated to investigation of one of the main institution of civil procedure law – civil jurisdiction. The structure-functioning analysis of court jurisdiction was conducted; the structural parts of it were defined. The suggestions concerning opti-mal structure of judicial system and procedural legis-lation were elaborated. The forms of court jurisdic-tion the same as conception and procedural forms of civil jurisdiction were considered. The universality of civil procedure form and the expedience of adop-tion united Civil Procedure Code are being substanti-ated. The analysis of dissociation criteria for the civil and the other forms of court jurisdiction (commer-cial, administrative, constitutional) was made. The propositions for civil procedural legislation and judi-cial practice are presented.
