Orzikh J. The Brokerage Agreement: Civil Aspect.

The candidate of law thesis is an independent, completed scientific work, devoted to complex researcher of the brokerage agreement in compliance with civil legislation of Ukraine. It was the first time when a complex research of the brokerage agreement under the civil legislation of Ukraine was conducted on the scientific level. The primary purpose of dissertation research are ascertain sense meaning and values of brokerage agreement in modern terms, decision of his signs and features, theoretical analysis of obligations, what arise up in the process of conclusion, change or termination of brokerage agreement, responsibility, for his violation, forming of suggestions, concerning legal regulation of brokerage relations in the civil legislation of Ukraine. In dissertation consistently probed civil legal nature of broker relations, place of brokerage agreement in the system of contractual obligation, correlation with other intermediary agreements. Certainly integrated character of brokerage agreement which takes place due to mixing of positions of such contractual constructions, as: contract of agency, commission, and agent agreement. The dynamics of broker obligation is analyzed, namely: order of conclusion, implementation, change and dissolution, stopping of relations, in a broker agreement, and also responsibility for non-fulfillment or non-proper implementation of brokerage agreement. Positions are in relation to perfection of civil legislation of Ukraine were formulated."
