Volkov O. Liability for damages inflicted in extreme necessity under civil law of Ukraine.

The dissertation researches and substantiates theoretical and practical issues of the liability for damages inflicted in extreme necessity under civil law of Ukraine. The concept and typology of the liability for damages inflicted in extreme necessity under Civil Code of Ukraine as well as their correlation with tort obligations are analysed. The peculiarities of subjective composition of the liability for damages in extreme necessity and the distribution of rights and obligations of the participants thereof were researched. Special attention was paid to the definition of extreme necessity and its distinction from the conterminous civil law categories. The justifiability of traditional terminology including some special categories in the sphere was analysed: appropriate propositions as to its refinement were moved forward. The proposals as to the perfection of the legal provisions in force were formulated."
