Scherbak I. Legal regulation of the economic relations of business enterprises with the participation of their separated subdivisions

Object of research: the economic relations of business enterprises with the participation of their separated subdivisions. The purpose of research: ground of new theoretical positions and development of concrete recommendations for the improvement of the legal adjusting of the economic relations of business enterprises with the participation of their separated subdivisions. Methods of research: historical, dialectical, comparatively legal, analytical synthetic, formal-logical, statistical. Theoretical and practical meaning: consists in possibility for use of results in legal activity for the improvement of legislation of Ukraine in relation to business enterprises with the participation of their separated subdivisions. The results used: at preparation of suggestions on making alterations and additions in a bill „About joint-stock companies"; in activity of Company „Donetsk metallurgical factory" at preparation of amendments and supplements to Statute about the representative office of Company „DMF", the prepared recommendations also can be used for the settlement of внутрихозяйственных disputes; drawn on separate results of research in activity of branch of Joint-stock COMPANY „Кiyvstar Dzh. Es. Em." in Dnepropetrovsk and its Donetsk separation; in an educational process at teaching of educational course „The basis of jurisprudences" are in the Donetsk national university. Scientific novelty: the present research formulates the idea and the expediency of the main characteristics of the separated business subdivisions in the terms of the current legislation. It also improves the current classification of the separated business subdivisions. The performance and the main characteristic features of business subsidiaries, representative offices and other separated business subdivisions as well as their participation in all kinds of economic relations have been thoroughly analyzed and examined in this research. The paper substantiates certain propositions on state registration, licencing of the foreign economicactivities of the foreign separated business subdivisions, their economic liabilities and some other proposals to be introduced into the current legislation. Sphere of use: subjects of initiation of bill; subjects of economic (for practical activity); the higher educational institutions.
