Piddubna V. Religious organizations as subjects of civil legal relationships

The dissertation is devoted to complex research of the problems of religious organizations as subjects of civil legal relationships under conditions of codification of civil legislation. The author reveals essence of religious organizations as participants of civil turnover, the following problems are solved: which features should a social formation be characterized with in order to be recognized as a religious organization; which legal models are used for these organizations’ participation in civil relationships; in which organizational-legal form of legal entities they can be created. The process of emerging of these organizations, civil-legal nature of a Statute as a local act, essence of a religious organization as a legal entity is researched. Contents of special legal capacity of religious organizations are revealed, i.e. property and non-property rights, which compose it (right to labeling, right to perform religious and non-religious activities, business activities). The author gives definitions of types of religious organizations and conducts differentiating of religious and public organizations. The propositions concerning improvement of legislation in the field of regulation of legal status of religious organizations are formed.
