Tytykalo R. Protective Function of Legal Assistance in Administrative Tort Processl

The thesis investigates theoretical, legislative and practical implementation problems of protective function of legal assistance in administrative tort process. The logic and methodology principles of defining such terms as “administrative tort process”, “protective function of legal assistance”, “the right of citizens to avail themselves of qualified legal assistance”, “defender in administrative offence proceedings”, and “defense tactics in administrative tort process” were described; the corresponding definitions were specified. Based on the analysis of Ukrainian legislation in force on administrative responsibility and its implementation practice, theoretical apprehension of scientific effort, the author stated a number of conclusions, propositions for the Code of Ukraine on Administrative Offenses, and provided rationale for a number of recommendations oriented towards improvements in the legal work of special entities providing legal assistance for parties to administrative tort proceedings with respect to protection of their rights and legitimate interests.
