Turchak I. Legal regulation of delivery contracts in conformity with market reforms in Ukraine (civil and legal aspect).

The thesis is devoted to the research of legal regulation of delivery contracts in conformity with market reforms in Ukraine. The sources of legal regulation of delivery relations in Ukraine were analyzed. Problematic questions which appear in practice in connection with regulation of delivery contract in Civil Code and Economic Code of Ukraine were examined here. The expedience of determination of provisions on contract in Ukrainian Civil Code is substantiated. The author ascertained that delivery relations except the codified acts are regulated by legislative acts of USSR. The features of delivery contract, which allow separating it from other types of contracts and examining it as a kind of contract on sale, were analyzed in this work. The essential conditions of a delivery contract, the rules of its making, fulfillment and revocation are determined in thesis. Civil and legal methods of providing due fulfillment of delivery contract were examined here. The liability for nonperformance and undue performance of delivery contract was determined. On the ground of the research the proposals for improving legal regulation of delivery contracts and proposed amendments to the legislation of Ukraine on delivery contracts were formulated."
